Both convicts recruited their buyers through Internet advertisements and asked them to deposit 20 percent of the total amount of the vehicle as a signal. Five people were defrauded, since the vehicles for which they had paid were not subsequently delivered. According to the aforementioned medium, the Provincial Court of Malaga has been in charge of passing the sentence on the son of the model.

"We condemn Carlo Costanzia Di Costigliole Flores and R.B.M., as criminally responsible for the perpetrators of a continuous crime of aggravated fraud, already defined, with the concurrence of the mitigation of highly qualified damage reparation, to the penalty, to each of them, 21 months in prison and a five-month fine with a daily quota of six euros, with a subsidiary personal responsibility in case of non-payment of one day of deprivation of liberty for every two unsatisfied daily quotas," said the authority.

According to the legislation of our country, people who are sentenced to less than 24 months can be released from prison if the judge deems it appropriate, but the judge considers in this case that "the convicted are not deserving of the benefit of the suspension of the execution of the custodial sentence imposed, since it is not about primary or specific offenders". The sentence justifies this position alleging the background of the son of Mar Flores.

"It is noted that from 2015 to 2021 he has been convicted on several occasions for crimes against road safety (for driving under the influence of alcohol or drugs, for driving without a permit and for reckless driving) and for crimes against public order (attack). But what's more, he has already enjoyed the benefit of the suspension and has not made good use of it", expressed the Provincial Court of Malaga.
