The "Aúpa Athletic" video in which a young woman was seen lifting an Athletic de Bilbao football club shirt and showing her breasts went to trial today. The person who recorded it was Ignacio Allende, better known as Torbe, porn film director. The girl was younger, 17 years old, but her video ended up going viral, shared among phones throughout Spain.
Today, a Court has placed Allende in the dock along with two other defendants for distributing the girl's video. Torbe was facing an eight-year sentence but the Prosecutor's Office and the accusations have decided to reach an agreement: two years in prison, 65,000 euros, two years' supervised release, the prohibition of approaching the victim for four years and he is prohibited working with minors for six years for the crimes of distribution of child pornography, discovery and disclosure of secrets and possession of child pornography.
The police began an in-depth investigation in 2015, with the minor's porn video being the tip of the iceberg. Several witnesses claimed that they were drugged to record porn videos, a father reported that they had taken advantage of his daughter with a mental illness and another series of testimonies about the modus operandi of this director, who also recorded bed scenes with his 'actresses'.
The investigators went after Torbe for carrying out bukakes - a pornographic genre and a practice of group sex, where a series of men take turns ejaculating on a person - with young women brought from Ukraine or Russia. From the investigation it was learned that in these scenes the girls were forced to swallow the semen of about a hundred men who had previously ejaculated in a bowl, and then they made them vomit it.
The police tried to get the Prosecutor's Office to support the investigation against Torbe for numerous crimes, including sexual and labor exploitation. However, the public prosecutor's office understood that the evidence was weak and limited itself to accusing him of the porn video of the minor that he himself distributed.
According to the defense, the girl lied about her age and made the porn film director believe that she was already of age. However, according to the facts that Torbe himself has acknowledged, when the girl contacted him to delete the video while moving through the networks.
The young woman assured that Torbe had promised her that her face would not be seen in the videos that were recorded. After that video spread on social networks, the parents of the girl - who was perfectly identified in the video - reported the events. Witness TP2 told the police how Allende forced her to have sexual relations with him against her will and offered to record a video with her boyfriend, in addition to a bukake and a glory hole, to which the minor he refused.
Torbe recorded several videos with the young woman having sexual relations with him. The prosecution's account, which he has acknowledged, states how after recording the scenes of sexual content, Allende asked the protected witness to put on the shirt of a historic soccer team so that, while he continued recording, he asked her to she would raise it, leaving her breasts exposed and exclaim “Aúpa Athletic”. That same day, the accused sent the video to the other accused and several soccer players without knowing “for certain” that TP2 was a minor. Three days later the girl asked Torbe to remove the video because it had gone viral and she was not yet 18 years old.
During the trial held today in the 27th Criminal Court of Madrid, the proven facts have recognized that the young woman had to leave her school, her environment and was unable to recover her studies.
Torbe has not even gone to court. After announcing that he was satisfied with a sentence of two years in prison, the magistrate allowed both him and the other accused to testify from their homes.
The film director has been sitting in his room for the entire trial session, wearing a blue polo shirt, contemplating what was being said in the courtroom. In the back, a room with a bookcase from end to end. The trial was resolved with a video call. Luckily for him, the trial was rather short-lived. He listened to what those present had to say while he held his chin in his hand, turned his chair, and touched his beard.
In an hour the trial was heard for sentencing. Her lawyer has asked not to have to serve the sentence and therefore that she be left solely with financial compensation. It is not the first time that Torbe has been convicted of a crime of corruption of minors. In 2008 he was sentenced to one year and a fine. Since the sentence has expired, his lawyer believes that he should not go to prison, although this decision is the final authority of the judge who dictates the sentence.
