The Prosecutor's Office requests 40 years in prison for Villarejo for his espionage for Repsol and Caixabank

The prison sentences requested by the Anti-Corruption Prosecutor's Office are already black on white for all those involved in the Wine Case, the espionage work that Repsol and Caixabank supposedly commissioned former commissioner José Manuel Villarejo to investigate the attempted takeover of the oil company by Sacyr and Pemex. The Public Ministry requests the highest penalty for the police officer at the epicenter of the Tandem plot -40 years in prison-, while for the former security directors of both companies involved it requests 21 years.

In a letter dated last Monday, Anticorruption attributes to Villarejo -who are still pending the sentence for the first three pieces that have been tried in the macro-cause- crimes of passive bribery, active bribery, discovery and disclosure of secrets of individuals with dissemination to third parties committed by a public official, discovery and disclosure of private secrets and falsification of commercial documents.

According to the thesis maintained by the Prosecutor's Office in its brief, the Cenyt Group -of which Villarejo was the owner together with his partner Rafael Redondo, for whom he also requests 32.5 years in prison- issued three invoices to its Repsol and CaixaBank clients, for a total amount of 389,400 euros, which Repsol and CaixaBank paid in equal parts.

Later, in 2014, Repsol went alone, "without the assistance of CaixaBank", to contact Villarejo, "with full knowledge that he was in active service as Commissioner of the National Police Force", to carry out a new commission, about a director of the oil company who had been absent from a session of the strategy commission to attend a soccer game. For these services, Villarejo issued an invoice for 24,000 euros for the "security information and analysis service", paid by Repsol by means of the corresponding bank transfer.

The judge investigating the case, Manuel García Castellón, came to charge the current president of Repsol, Antonio Brufau, and the former president of CaixaBank, Isidro Fainé. However, he finally filed the case against them months ago, understanding that both had no contact with Cenyt. In the words of the instructor, they did not give the order to "hire" the former commissioner nor did they know the "details" of the services that he could have provided.

In its letter, Anticorruption also requests that Repsol and CaixaBank be considered subsidiary civil liability, as well as the general administration of the State. The Public Ministry considers that the defendants must indemnify Rodrigo Álvarez and Fernando Ramírez with 8,000 euros, amounts that Repsol, CaixaBank and the administration should face in a subsidiary way; It also calls for the confiscation of the 389,400 euros paid by Repsol and CaixaBank for the execution of the project, and the 24,000 paid by Repsol in 2014.

With regard to the civil liability of the two companies, they must respond for the damages that, if any, their employees or former employees generate, for which they must first be sentenced, then determine if there was damage and that the sentenced ones did not do so. can cover.
