The judge of the National Court José Luis Calama has agreed to the release with precautionary measures for the man who was in provisional prison as the alleged author of sending six letters with explosives to the President of the Government, Pedro Sánchez, to the Defense Minister, Margarita Robles, to the Ukrainian embassy in Madrid, to the facilities of the Instalaza company, to the United States embassy in the capital and to the Torrejón Air Base satellite center.
In an order, the magistrate imposes as precautionary measures on Pompeyo González the obligation to appear weekly in the court closest to his home, the prohibition to leave the territory, the withdrawal of the passport, as well as the obligation to establish an address and a phone number where you can be reached.
In line with the report issued by the Prosecutor's Office, Judge Calama understands that release without bail is appropriate since there is no current risk of destruction of evidence sources, since the most relevant investigative procedures have already been carried out to obtain of the substantial criminality indications that point towards said investigated.
In addition, the instructor explains, the person investigated has no criminal record prior to the events being investigated in court, there are no indications that point to a possible criminal reiteration and he has a known address and roots in the Burgos town of Miranda de Ebro.
The judge also takes into account the advanced age (74 years) of the person investigated, who has been in pretrial detention since January 27 and that other precautionary measures of less relevance than pretrial detention such as those agreed upon, that is, appearances apud act, as well as the withdrawal of the passport and the prohibition to leave Spain.
Pompeyo González was arrested in January after an investigation by the National Police, which was on the trail of sending several letters with explosives.
By sending these packages, Pompey would seek, in the magistrate's opinion, "to force the public powers of our country to refrain from the support shown in favor of Ukraine in the face of Russian aggression," the prison order states.
A total of six crimes are attributed to him: four of terrorism and two aggravated terrorism (for shipments to members of the Government, specifically Pedro Sánchez and Margarita Robles), all of them in competition with another crime of using flammable or incendiary explosive devices with terrorist purpose.
