The judge closes the case of the CDRs again and leaves its members one step away from trial for terrorism

The judge of the National Court Manuel García Castellón has concluded the summary of the so-called CDR for the second time after complying with the order of the Criminal Chamber to extend the investigation and carry out the proceedings requested by one of the investigated.

In his order, the magistrate sends this summary to the Criminal Chamber for prosecution for crimes of belonging to a terrorist organization and possession, deposit and manufacture of flammable explosive substances or devices of a terrorist nature.

The judge explains in his brief that the steps that have been considered necessary and useful to clarify the facts have been carried out, therefore it is appropriate to issue the conclusion of the summary by verifying that the summary investigation has seen its purpose fulfilled, identifying the responsible for the act, qualifying the crime and insuring the persons and property that must be responsible for it.

After this resolution, twelve members of the Defense Committees of the Republic (CDR) arrested in September 2019 in the "Judas operation" are closer to sitting on the bench for crimes of terrorism. The judge had already concluded the summary after the prosecution but the Chamber ordered him to reopen it to incorporate documentary evidence.

Specifically, the court upheld the request of one of the defendants to reopen the investigation by questioning the origin of the case and that it could create defenselessness when a still secret part was found. García Castellón had to accept that the defendants requested the proceedings they considered appropriate before returning to conclude the summary.
