The investigating judges of Barcelona join the rejection of references to 'lawfare'

The investigating judges of Barcelona have issued a statement in which by a majority they join the rejection expressed by judicial associations and the senior judges of the agreement signed by Junts and the PSOE that referred to 'lawfare or judicialization of politics'.

At the meeting of investigating judges held this Thursday at the Ciutat de la Justicia in Barcelona, the 24 instructors who attended the meeting decided by 21 votes in favor, one against and 2 abstentions to support the position established by the judge. dean of Barcelona, Cristina Ferrando, who signed a document together with 80 senior judges from Spain in which they expressed their rejection of the allusions to 'lawfare'. “Endorsing the decision of the senior judge of Barcelona to adhere to the statement issued by the judicial associations on November 9,” the document stated.

Last week, eighty senior judges from all over Spain decided to issue a statement to express their opposition to the reference to 'lawfare', considering that it could involve "interference in judicial independence" and the "breakdown of the separation of powers." which appeared in the investiture agreement signed between Junts and the PSOE. Among the signatories were judges who practice in Catalonia such as the senior judges of Barcelona, Girona, Sabadell and L'Hospitalet de Llobregat.

In their joint statement, the associations reproach the “distrust in the functioning of the Judiciary” which, in their opinion, emerges from the reference to “lawfare”, that is, the use of judicial procedures for the purposes of political persecution, which finally they have not been transferred to the amnesty bill. “The Judiciary in Spain is independent, does not act under political pressure and has a system of jurisdictional guarantees that eliminates the risk that is pointed out,” they stated.
