The Fourth Section of the Provincial Court of Valencia has sentenced a man to a prison sentence of six years and eight months for touching his minor daughter, showing her pornographic films and engaging in explicit sexual conduct in front of her.
The Court considers him the author of a crime of sexual abuse, another of exhibitionism and a third of sexual provocation, all of them with the aggravating circumstance of kinship, for which it also imposes the obligation to compensate the victim with 25,000 euros for the damages caused. He suffered as a result of the events and the consequences they caused.
The man will not be able to get closer than 500 meters or communicate with her by any means for ten years. In addition, the sentence also condemns him to deprivation of the exercise of the right of parental authority for a period of five years.
The events occurred between 2016 and 2017 at the family home, located in a municipality in the Horta Sud region when, according to the judicial resolution, the convicted person took advantage of the moments in which he was alone with his daughter, between 9 and 10 years old, due to the visitation regime he had when he was divorced from the victim's mother.
At these times, the man began to watch pornographic films in which men and women were seen having sexual relations with violent behavior in which the women were insulted. The parent became excited in front of the minor, and performed explicitly sexual acts and behaviors in front of her.
Likewise, he took advantage of when his new partner was not at home to go up to his attic with the girl and showed her films with pornographic content in which the actresses pretended to be princesses from the Disney universe, while he touched her genitals or forced him to to touch them to him.
In addition, the man made the minor record obscene videos, as a game and as if it were a dance, in which she exposed her naked ass. The victim's mother discovered one of these videos and filed a complaint on June 26, 2017. The sentence is not final and can be appealed to the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
