A man is tried for trying to kill his neighbor in Reus after an argument

The Tarragona Court has begun to try a man for trying to kill his neighbor after an argument over the volume of the music. The facts date back to November 5, 2021. Then, the defendant shot the victim twice without success and then stabbed him several times, according to the letter from the public prosecutor's office.

The Prosecutor's Office requests seventeen years in prison for the crimes of attempted murder and illegal possession of weapons. It also requests 2,150 euros of civil liability for injuries and moral damages. The private prosecution raises the sentence to 26 years in prison for the same crimes, while the defense demands a "fair" sentence.

The trial has started with the defendant's statement, who has only responded to his lawyer's questions. The investigator acknowledged that he had a fight with the victim and assured that he entered his house to get the knife and the gun because he was afraid of his neighbor, his lawyer explained to ACN. In addition, the defendant argued that the first shot was fired after he tripped and that he "never intended to kill anyone." According to the defense lawyer, the defendant has declared that both ended up covered in blood as a result of the fight and that the weapon jammed after the first shot.

The man, who was stabbed and shot by the defendant, explained that he had no problem with the defendant, although he stated that his mother had had a run-in. The witness recounted that they quarreled and that he asked for help from a man who was passing by on the street, whom he did not know. He has detailed that they reduced the investigated and that the other man called 112. "I was on top of the defendant, my mother and the man who helped me were standing when the Mossos arrived," said the young man.

The victim's mother also testified that the defendant shot directly at her son and put the gun to his chest. "I was in a state of shock, my son pushed the gun away with his hand. Then, the defendant stabbed him, I had not seen the knife, I saw it suddenly," she described. In addition, she said that while her son defended himself, she hit the defendant: "I only saw my son's blood, we wanted to try to stop him and stop him from targeting us anymore." She has also explained that as a result of these events, both she and her son have needed psychological help, due to post-traumatic stress and anguish, and that they have had to change their address.

As for the third witness, he explained that he was leaving work when he heard a boy ask for help. "I saw a man with a gun through the fence, the young man asked me for help, as he and I could, we took the gun from him and reduced him, I called 112," he said.

In view of this Wednesday, July 5, the agents of the Mossos d'Esquadra who intervened in the action also declared. The witnesses stated that when they arrived at the scene they found the defendant on the ground and that the victim was holding him back. Both were covered in blood from the fight. The agents explained that the investigated became more nervous and aggressive when they denied him entry to his home because he wanted to wash his face that was full of blood.

Another of the witnesses explained that they entered the home because the defendant asked them to feed his dog before taking him into custody. When they entered the house, they found a hunting shotgun, another pistol and twelve cartridges, which did not have a license. The agent acknowledged that they reported on the weapons found in the investigation and that they took them, although they lacked the entry order and search of the home.

The prosecutor requests a prison sentence of fourteen years for the crime of attempted murder and another three for the crime of illegal possession of weapons. It also prohibits him from approaching the victim within 500 meters and from communicating with her for a period of sixteen years. In addition, she requests eight years of probation. As for civil liability, she claims 150 euros for injuries and another 2,000 for moral damages.

For his part, the lawyer for the private prosecution asks for 26 years in prison. Specifically, he requests ten years for two crimes of attempted murder and another six years for three crimes of illegal possession of weapons. Likewise, he claims compensation of 500,000 euros for each victim, the man attacked and his mother, alleging that both have suffered post-traumatic stress disorders and anxiety. On the other hand, the defense lawyer asks for a "fair" sentence, without specifying the penalties.
