The court considers as aggravating factors the situation of superiority and fear that the accused exercised throughout the years in which the attacks lasted, between 2004 and 2009, and the family relationship that he held as the stepfather of the girl, who was 12 years old. the moment the events begin.

The magistrates base their sentence on the truthful and repeated testimony of the minor and on the psychological reports that reveal a situation of post-traumatic stress in the girl due to the experiences suffered over the years.

They also consider the intimidation exercised by the accused to be proven, by creating a "climate of terror" that nullified the ability to resist, and they rule out the aggressor's exculpatory version based on the different evidence taken during the hearing.
