A judge stops the attempt to paralyze the amnesty before it is even proposed

A Madrid Court has stopped for now a citizen's attempt to have Justice act to prevent the Congress of Deputies from processing the proposal for the amnesty law that is still being negotiated for its presentation as a preliminary step for Pedro's investiture. Sánchez as President of the Government.

A wave of typical lawsuits has been generated, promoted by a lawyer, to invade the courts until someone considers their claims and intervenes in the actions of the lower house.

As it is a civil procedure, admissions to processing are automatic. The lawyer of the Court of First Instance number 104 of Madrid has suspended the preview that had been called for next day the 13th to review the requested precautionary measures.

In light of the facts, the head of the Court will first review the jurisdiction and then the substance. Legal sources explain that since it is a lawsuit against the parties that signed the future proposal and the Congress of Deputies itself, the jurisdiction to analyze the matter could be the National Court or the Supreme Court.

However, these same sources explain that the scope of the demand has little scope as it is requesting to paralyze a text whose content is not even known nor has it been presented, given that at this time negotiations between PSOE and Junts are still continuing to set the definitive text.

In the framework of tension that has opened as a result of the future amnesty for those responsible for the process, a lawyer has created a standard lawsuit so that everyone can go to a Court, and which they already estimate could amount to 3,000.

This asks the judge for precautionary measures to prevent both the presidency and the Congress table from "holding a plenary session for the approval of an amnesty law for those investigated, accused and convicted for their participation in the Catalan process" until this lawsuit is resolved. He also requests that the court order be sent to the parliamentary groups of PSOE, Junts, ERC and Sumar.

The argument of the lawsuit is the violation of equal treatment included in the Constitution between those granted amnesty and any other citizen since "it is intended to amnesty certain people through a political act", far from the reasons of justice sought or grace that legislation establishes for this measure.
