Campo, judge of the TC, abstains from the amnesty

The progressive magistrate of the Constitutional Court (TC) Juan Carlos Campo has decided to abstain from everything that has to do with the amnesty law, still in the parliamentary processing phase, since he, as Minister of Justice, elaborated the pardon reports for those convicted of sedition in the process and in which it was already said that the amnesty was "unconstitutional".

Campo, judge of the TC, abstains from the amnesty

The progressive magistrate of the Constitutional Court (TC) Juan Carlos Campo has decided to abstain from everything that has to do with the amnesty law, still in the parliamentary processing phase, since he, as Minister of Justice, elaborated the pardon reports for those convicted of sedition in the process and in which it was already said that the amnesty was "unconstitutional".

He notified the president of the court, Cándido Conde-Pumpido, of this yesterday, after an appeal for protection presented by an individual who seeks to stop the approval of the law promoted by the PSOE with pro-independence parties.

This means that the TC's progressive block will be left without a member, pending what Laura Díez and Conde-Pumpido will do, who are already being asked to leave the affair.

In the case of Campo, after approving the pardons, the President of the Government, Pedro Sánchez, fired him, which made him return for a few months to the position of magistrate of the National Court, and then he was again rescued and elected magistrate of the Constitutional Court.

Sources close to Campo claim that he had been studying for some time whether to withdraw from the amnesty matter when he arrived at the court, given his involvement in the matter when he was Minister of Justice.

Another thing will be what Conde-Pumpido does, who in 2021 abstained from all cases linked to the process after the pro-independence leaders rejected him when they felt he was not "neutral" or "impartial" by a conference that went held in November 2017 in which he gave his opinion.

Then, he expressed his "concern" about the events taking place in Catalonia and described them as "an attempt to subvert the social and democratic State of law by fraudulently using the very flag of democracy". In the event that both had to abstain, the plenary would be left with five progressives and four conservatives.
