The Supreme Court has confirmed the sentence to nine years in prison for a man who raped his underage stepdaughter for six years, almost daily, at her home in Madrid, a situation that almost led her to suicide.

The Criminal Chamber has handed down a sentence, to which Efe has had access, which rejects the appeal of the convicted person against the resolution of the Superior Court of Justice of Madrid that ratified that of the Court of Madrid for a continued crime of sexual abuse with penetration.

The sentence relates that when the girl was 11 years old, the stepfather began to tickle her, which she interpreted as if it were a game until she was 13 years old in 2011.

Then, the stepfather instructed his daughter to "in exchange for offering them favors, have complete sexual relations almost every day in the family home," which "generated in the minor the false belief that if she wanted something from her father, she should submit to that practice." This situation continued until she turned 18 years old.

Such sexual relations during such a long period of time have caused the minor depressive symptoms, with psychological and pharmacological treatment, consisting of helplessness, impotence and insecurity, loneliness, low self-esteem, attention and concentration difficulties, feelings of shame, guilt and disgust, demotivation and even suicide attempts.

In this case, the Criminal Chamber does not apply the law of only yes is yes because it is not more beneficial for the prisoner. On the contrary, with this regulatory framework, the minimum sentence would be 12 years and six months, that is, three and a half years more than the sentence imposed.

In addition to the prison sentence, the Supreme Court confirms the prohibition to approach and communicate with the minor for eight years, probation for five years and compensation of 50,000 euros.
