Jersey City man on probation facing new pot and heroin charges

JERSEY CITY - A 27-year-old man already on probation was arrested on charges he had seven bags of suspected heroin and distributed three of them near a Jersey City school and public property last week.

Marshall Whaley, of Bostwick Avenue near Martin Luther King Drive, was arrested Wednesday and charged with possession with intent to distribute four bags of suspected heroin and two bags or suspected marijuana, the criminal complaint says.

He is also charged with possession with intent to distribute within 1,000 feet of Sacred Heart School, located at 183 Bayview Ave., and within 500 feet of Glenn D. Cunningham Public Library, located at 275 MLK Drive, the complaint says.

Finally, Whaley is charged with distribution of three bags of suspected heroin near the school and library, the complaint says.

Whaley has prior criminal convictions and other charges pending, court officials said when he made his first appearance on the new charges on Friday in Criminal Justice Reform Court in Jersey City via video link from Hudson County jail in Kearny.

At the hearing, Whaley was ordered released with various conditions of supervision pending trial.
