The young woman who denounced the soccer player Dani Alves for an alleged sexual assault at the Sutton nightclub in Barcelona has filed an appeal before the investigating judge in which she refuses to be examined by the private psychologist proposed by the defense to determine if her story and her symptoms are consistent with a violation.

As reported to EFE by legal sources, the victim's lawyer, Ester Garcia, has filed an appeal against the decision of the investigating judge to give the green light to the expert on behalf of the defense, considering that the exploration is sufficient. to be carried out by the coroner.

The Prosecutor's Office has also appealed the decision of the head of the trial court number 15 of Barcelona, ​​who, as requested by Alves' defense, exercised by the lawyer Cristóbal Martell, agreed that the young woman be examined both by an independent forensic Legal Medicine and Forensic Sciences (IMLC) and by a psychologist hired by Alves.

The psychological examination of the victim, an essential test in cases of sexual assault to determine whether what the victim reported and the symptoms she presents are compatible with having suffered a rape, remains suspended for the moment, waiting for the judge to rule on the resources presented.

The defense of the former FC Barcelona player, who intends to delve into his thesis that the victim's complaint suffers from a "narrative distortion", not only asked the court for an expert opinion, but also that the psychological examination of the young woman be recorded on video.

Both the Prosecutor's Office and the private prosecution exercised by the complainant opposed the recording of the psychological examination, which they consider unusual in the criminal sphere, and the investigating judge ended up rejecting it, a refusal that in turn led to a defense appeal.

The investigation of the case for alleged sexual assault, which occurred in a private room of the Sutton nightclub in Barcelona on December 30, thus remains aground, waiting for the justice to settle the discussion on the expert evidence, although the investigations have already been carried out. main proceedings, such as witness statements and analysis of biological evidence.

Alves' defense could again request at any time the provisional release of the footballer -who has been in preventive detention for two months-, although they have not done so at the moment.
