The perpetrators of the injuries, due to negligence or willful, produced as a result of traffic accidents, must pay the victims compensation, as civil liability. The amount of these compensations will depend on the seriousness of the injuries caused to the victim and the repercussions that this has on the normal development of their daily lives.

In case of whiplash, bone fractures or the aggravation of previous injuries or pathologies, the judicial experts will establish the degree of damage and the estimated days for healing. For their part, it is the Administrations that annually update a scale with which the financial compensation to be received by the victims is calculated.

The scale that is currently in force is included in Royal Decree 1058/2022, of December 27, which modifies the Law on Civil Liability and Circulation Insurance. This standard presents a significant improvement in the amounts of compensation for victims of traffic accidents, with an increase of 8.5%. This figure is given by the interannual inflation data, since this same norm is the one that regulates the revaluation of pensions.

In this way, the law determines the amounts of civil liability according to the days of healing required according to the injury. Thus, each day of basic damage due to a temporary injury, such as whiplash, will be compensated with 35.71 euros. In the event that the victim suffers a significant loss of their quality of life (moderate damage), they will have to be compensated with 61.89 euros per day.

The amounts increase proportionally depending on the degree of the injury. That is why for each day of serious damage, as can occur in the case of limited mobility or the amputation of a limb, the victim must be paid 89.27 euros. For cases of tetraplegia or paraplegia, framed as very serious damage, the compensation will amount to €119.03 euros for each day of treatment necessary.

The law also contemplates other types of situations. For example, compensation for each surgical intervention required by a victim ranges between 476.10 and 1,904.40 euros. On the other hand, if the injury caused by a traffic accident caused total or partial disability to the victim, the civil party responsible must indemnify him with amounts ranging from 27,442 to 1,449,505 euros, depending on age and net salary. perceived by the affected.

With regard to fatalities in traffic accidents, the responsible perpetrator must indemnify his immediate environment. For widowed spouses, civil liability is established between 59,512 and 107,213 euros, depending on the age of the victim and the years of marriage. Meanwhile, the descendants of the victims must be compensated with amounts between 23,805 and 107,123 euros.
