The CNMC investigates Naturgy for possible abuse of a dominant position

The National Markets and Competition Commission (CNMC) has initiated a sanctioning file against UFD Distribución Electricidad, its parent companies Holding Negocios Electricidad and Naturgy Energy Group (Naturgy Group), and the subcontracted company Lean Grids Services for a possible abuse of position of domain.

As detailed by the organization in a statement, the company would have carried out an "exclusionary" strategy, a series of market closure practices, as well as the imposition of discriminatory conditions on third-party competitors in the equipment installation and service provision market. .

These practices violate article 2 of Law 15/2007 of July 3 on the Defense of Competition (LDC) and article 102 of the Treaty on the Functioning of the European Union (TFEU).

The investigation began following a complaint from Axon Time and Enerlin Ingenieros against UFD for practices contrary to the aforementioned regulations and confidential information carried out by the Competition Directorate. Suspecting possible anti-competitive practices, the CNMC even inspected two headquarters of the Naturgy Group. Now the agency has a period of months to investigate and resolve the file to resolve the guilt or innocence of the facts being investigated.
