Clarke insisted that the DOJ found that "Space X recruiters and senior management actively participated in attempts to discourage asylees and refugees from seeking opportunities with the company."

In fact, in a 2020 post by Musk on the then social network called Twitter (before he bought it and renamed it X) he assured that "United States laws require at least the 'green card' to make contracts in Space X, since rockets are advanced weapons technology." The government denies that in its entirety in the lawsuit, calling the statement "a discriminatory public statement."

The complaint seeks to “obtain fair consideration and back pay for asylees and refugees who were deterred or denied employment at Space X due to alleged discrimination,” as well as sanctions and policy changes by the company. .
