THE TSJC confirms the nullity of the last elections to the Chamber of Commerce

THE TSJC confirms the nullity of the last elections to the Chamber of Commerce

A few hours before the start of the controversial plenary session of the Barcelona Chamber of Commerce, which must approve a declaration of support for the Consell de la República and the removal of the Bourbon crown from the institution's coat of arms, the Superior Court of Justice of Catalonia (TSJC ) has confirmed the nullity of the last elections, which were won by the independence candidacy Eines de País.

The court has decided not to admit for processing the appeal of the Generalitat against a previous sentence of the TSJC that annulled the 2018 decree on the electoral regime of the Catalan chambers. In this way, the annulment of that decree is now final and, therefore, the elections that were held exclusively with electronic voting are invalid.

After this resolution, the company that challenged the decree - Staff Pavillon - has sent a letter to the president of the institution, Mònica Roca, in which she urges her not to make decisions because her government team would not be legal, adhering to what they have the courts ruled. In the same sense, he has addressed the president of the Consell de Cambres, Jaume Fàbrega. The company asks that the plenary sessions convened be suspended and, in any case, that no agreement be adopted that could affect the operation and development of the chambers or the general interests they represent. And he adds that at this time new elections should be called because, if not, serious responsibilities can be incurred, including criminal ones.

A very important decision for the Barcelona Chamber where, in addition to express support for the Consell de la República and the change of coat of arms, a change of statutes is planned to be voted today to reduce to two – out of the current maximum of 14 – the number of “paid chairs”, the seats they win without going through the polls in exchange for an economic contribution.

The TSJC annulled the decree of the Generalitat considering that the process of citizen participation in the preparation of the regulations had been omitted. To justify the omission of this essential procedure, the Generalitat alleged reasons of urgency, but the judgment considers that this urgency has not been accredited and that, consequently, the rights of citizens to participate in the process of development of standards. Against this ruling, the Generalitat filed an appeal before the Supreme Court, which was also not admitted, and subsequently the appeal before the TSJC, which was also not admitted. Therefore, the annulment sentence of the decree is final.
