The struggle of the affected families has led the Provincial Court of Madrid to force the Court of First Instance and Instruction number 3 of Collado Villalba to reopen a case against the regional president, Isabel Díaz Ayuso, and her former Ministers of Health and Interior, Enrique López and Enrique Ruiz Escudero, respectively, for the deaths of users of a nursing home in the first wave of the Covid-19 pandemic.

In an order dated November 2, to which Europa Press has had access, said court accepts the appeal filed by an affected family, filed in the first instance, and agrees with the Court to continue the investigation regarding them "with the practice of the pertinent and necessary procedures to be able to conclude whether or not there are indications of the commission of a crime of homicide or reckless injuries and/or omission of the duty to provide assistance.

If the investigation is successful, the Court would have to recuse itself in favor of the Supreme Court to investigate the regional president as she has the status of a registered judge, and in favor of the Superior Court of Justice of Madrid in that of Enrique Ruiz Escudero as he is an autonomous deputy. .

Among the new proceedings, the Court agrees in said order to summon the defendant again to take a statement, requiring the Torrelodones-Sanitas Mayores residential center through its attorney to provide identification to this case within three days. be able to quote it.

It also orders the statement as a witness of the Minister of Social Policies during the first wave of the pandemic, Alberto Reyero, for November 7 at 9:30 a.m.; that of the former director of Social and Health Coordination of the Community, Carlos Mur, a quarter of an hour later; and the then general director of Public Health, Yolanda Fuentes, at 10:15 a.m.

Likewise, the Court issues an official letter to the Ministry of Health to provide the Shock Plan against deaths in residences announced on March 26, 2020, as well as its development, implementation and resources used in it.

It also asks for the coordination protocols for the care of institutionalized patients in nursing homes in the region during the epidemic period caused by Covid-19, adopted by the General Directorate of Socio-Health Coordination; as well as the health resources and PPE provided by the Community of Madrid to the residences, broken down by date.

Likewise, the Court considers presented the expert medical report issued by a doctor specializing in Geriatrics, who will have to ratify said report on November 7 at 10:15 a.m. in court presence.

Likewise, the Court agrees, in accordance with the request of Sanitas Mayores SL, to ask the Geriatrics Service of the Puerta de Hierro University Hospital to send to the Court a copy of the geriatrics report dated March 31, 2020, corresponding to a patient so that it can be reviewed by the Forensic Medical Examiner assigned to this Court.
