The Prosecutor's Office of the National Court already has on the table four complaints filed against the current president of the Royal Spanish Football Federation (RFEF), Luis Rubiales, for the kiss on the mouth that he gave to the player of the Spanish women's team Jenni Beautiful after winning the World Cup in Australia.
The public ministry has confirmed that there are four complaints that have reached the State Attorney General's Office against Rubiales. Three are private and the fourth has been filed by the Alianza contra la Corrupción association.
The General Prosecutor's Office, directed by Álvaro García, has forwarded the writings to the National Court Prosecutor's Office, understanding that it would be the competent body because the events occurred abroad, specifically in Sydney.
For now, these complaints have simply been forwarded to the National Court Prosecutor's Office, which must now decide whether to open proceedings for an alleged crime of sexual assault, included in article 191 of the Penal Code.
Prosecutor sources explain that the first thesis of the public ministry is that it is not possible to act without the prior complaint of the victim, in this case the player.
One of the options that arises is that the Prosecutor's Office offers the player to file the appropriate actions if she considers it so. Although in the type included in the Penal Code on sexual assault it states that there may be an ex officio complaint from the public prosecutor, prosecutors sources explain that the usual practice is that in this type of situation and being the adult victim and being in full physical and Mental health, wait until she is the one to file a complaint if she considers it so.
What the Prosecutor's Office must analyze is whether the kiss was consented to or against the will of the player. In the press conference offered by Rubiales this morning after the RFEF assembly, he defended himself arguing that it was a consensual kiss and without any kind of sexual intent. In addition, he maintained that it was Hermoso herself who first raised him after the euphoria of winning the World Cup. According to his version, before kissing her he asked her: a little peck? and she said okay."
That was the sequence that according to Rubiales the events occurred. Now it remains to be seen if Hermoso makes a new statement denying or qualifying the words of the RFEF president at the press conference, in which he has announced that he refuses to resign due to these events.
