The Prosecutor's Office requests that the European arrest warrant against Lluís Puig be reactivated

The Prosecutor's Office has asked Judge Pablo Llarena to reactivate the European and international arrest warrant against former Minister Lluís Puig, in Brussels together with former President Carles Puigdemont, as he is being prosecuted for embezzlement of public funds and disobedience.

The Prosecutor's Office has asked Judge Pablo Llarena to reactivate the European and international arrest warrant against former Minister Lluís Puig, in Brussels together with former President Carles Puigdemont, as he is being prosecuted for embezzlement of public funds and disobedience.

After the repeal of the crime of sedition, the Supreme Court annulled the arrest warrants until Judge Llarena issued new ones with the new crimes, replacing sedition and adjusting them to embezzlement and disobedience.

The Prosecutor's Office now asks the investigator of the trial case to reactivate the OED against the former minister once the Court of Justice of the European Union (CJEU) does not oppose the issuance of several successive European arrest warrants against a person wanted with in order to obtain his surrender by a Member State after the execution of a first European arrest warrant directed against that person has been refused by that Member State.

"Therefore, the requirements established by current legislation for mutual recognition of criminal resolutions of the European Union are met, which allows the competent Spanish judicial authority to issue an arrest and surrender order," states the document submitted to the Supreme Court.

The Prosecutor's Office already did the same with respect to Puigdemont and Toni Comin, in their case on July 24, one day after the general elections. This request came after the ruling of the General Court of the European Union of July 5, 2023, which removed the immunity of both MEPs.

Llarena refused to resolve the request of the Public Ministry and the popular accusation until the Court of Justice of the European Union rules on the possible precautionary measures that both can present to see their parliamentary immunity provisionally restored. After Llarena's decision, Puigdemont has left Belgium again to star in some events in Catalunya Nord, on French territory.
