The popular jury declares the accused guilty of stabbing a family member in Pont de Vilomara

The popular jury has found the accused of killing a relative at the Pont de Vilomara i Rocafort (Bages) guilty of manslaughter in 2020. With 7 votes in favor and 2 against, the members of the jury consider themselves responsible for the death of the victim after murdering her with 45 stab wounds in different parts of the body.

The jury considers that at that time the defendant had various mental disorders, so they understand that there was no treachery or cruelty in the death of her relative. Despite this, they do not rule out "the possibility that there were moments of conscience" and, therefore, close the door to a suspension of the sentence.

The verdict gives credibility to the location and timing of the events based on the statements of the different testimonies that have been listening during the trial.

According to testimonies, around 9:30 on July 2, 2020, the defendant attacked her relative with a knife. The jury considers that she started when they were in bed and that the victim did not realize the attack, since the first stab wounds would have been received there.

What is not considered proven is that the defendant took advantage of the moment to harm the woman, since she considers that "it is not possible to know if there was intention or not", but they do not rule out certain moments of "conscience". The jury also accepted the figure of 45 stab wounds in different parts of the body such as the neck, face and back, which became the cause of death.

The jury concludes that the stab wounds caused the victim "more pain than necessary" since only a few were "fatal" and, instead, he received a considerable number. What he considers that it cannot be known is whether "there was a purpose" to provoke him on the part of the accused.

An alteration that unanimously endorses, giving credibility to the psychiatric reports presented. Despite this, the jury considers that it did not completely annul her, and finds her guilty of the death of her family member, even though she did not take advantage of the circumstances of the attack nor did she want to cause him great suffering.

Finally, the popular jury has ruled against the suspension of the sentence, as well as the possibility of receiving a pardon. After hearing the verdict, the Court has suspended the session for giving the parties time to reformulate the writings and petitions in having fallen "part of the argumentative structure" according to the magistrate. This will be resumed today before leaving the trial seen for sentencing.
