In principle, both are being investigated for the possible commission of a crime of family abandonment, although it is not ruled out that new charges may be added as the investigation of the case progresses, such as attempted murder.

What both courts have ordered are a series of precautionary measures, such as the prohibition for both parents to approach the minor, the withdrawal of the passport, the prohibition of leaving the national territory and the periodic appearance in court to undergo identity control. the judicial authority.

The case, which will be heard by Court number 10 of Malaga, progressed after the location and subsequent arrest of the parents in Malaga and Córdoba.

Many hours of viewing security cameras, the corresponding visual inspection at the scene, among other investigative procedures, in addition to the collaboration of the Scientific Police, allowed the Homicide Group of the Provincial Police Station of Malaga to identify the father of the abandoned minor and, based on the previous one, find the whereabouts of the mother.

The date of birth is estimated, according to the investigation, between 03:00 and 04:00 on Saturday, October 14. A passerby located the baby, naked and showing signs of hypothermia, around 8:30 a.m. The newborn was found alive in some bushes in the El Duende park and taken in a National Police radio patrol vehicle to the hospital.

The Police gathered different evidence that confirmed how the newborn would be abandoned to her fate for approximately four hours. The place of birth was close to the bushes where the minor was abandoned. According to the investigations, those investigated supposedly left her daughter between the hedges and then left the place, without notifying anyone.
