The National Court confirms the trial of 12 members of the CDR for terrorism

The Criminal Chamber of the National Court has confirmed the order to conclude the summary of the case of the so-called CDR and has agreed to the opening of an oral trial against twelve people who were prosecuted for the crimes of membership in a terrorist organization and possession, storage and manufacture of flammable explosive substance or devices of a terrorist nature.

This resolution comes in the midst of negotiations to approve the amnesty law for institutional, political and social normalization in Catalonia, which would lead to the annulment of all cases linked to the process, including this case.

In an order, the magistrates of the Third Section confirm the decision of the investigating judge of the so-called “Operation Judas” carried out in September 2019 against a group of people whom the magistrate linked to the so-called “Tactical Response Team” (ERT). ), a cell made up of individuals from different CDRs with great radicalism and who intended, through violence, to achieve the independence of Catalonia.

Several of the defendants appealed to the Criminal Chamber to revoke the order of summary conclusion and put forward different arguments, among others, they requested the carrying out of investigative procedures that the Chamber considers unnecessary in some cases and, in others, it explains that They may agree at the oral hearing.

Furthermore, in its order the court rejects the request for dismissal made by three of the defendants who alleged a lack of evidence of the commission of a crime of belonging to a terrorist organization. The Chamber gives the Prosecutor's Office a period of five days to classify the facts.

The Chamber thus confirms the decision of the investigating judge Manuel García Castellón to send them to trial. According to the magistrate, this group of people constituted the so-called Tactical Response Team (ERT), which was made up of highly radicalized elements that came from different CDRs.

This cell was understood as a group of the highest trust in charge of the most sensitive actions. García Castellón describes them as convinced of independence and radical activism as a way to achieve their goal. These means included, according to the judge, the use of violence with the aim of forcing State institutions to grant the separation of Catalonia through deeds.
