The Girona duty judge has provisionally released the drunk, drugged driver without a driver's license who suffered a fatal accident in which his underage brother, who was co-driver, lost his life.
The 20-year-old driver was arrested for an alleged crime of reckless homicide and two more crimes against road safety (one for driving without a license and another for driving under the influence of alcohol), suffered minor injuries and was transferred to the Hospital Girona Trueta.
This morning he has gone to court and the judge has released him with the obligation to appear when summoned. The Girona court will be inhibited in favor of the Olot 2 investigative court, which was on duty at the time of the events.
The incident occurred this Monday around 06:35 in the morning at kilometer point 1 of the local highway GIP-5223, near Riudaura. The car that the detained young man was driving left the road and overturned. As a result of the crash, the co-driver, a resident of Montagut i Oix (Garrotxa), lost his life. The victim was the driver's brother.
The driver gave an alcohol level of 0.60 mg/l experienced air and gave a positive drug test. He had never had a driver's license before.
