The JEC summons Puigdemont to go to Madrid for his MEP act

The Central Electoral Board (JEC) has issued a resolution responding to the president of the European Parliament, Roberta Metsola, in which it clarifies that the former Catalan president, Carles Puigdemont, and three other Catalan MEPs, with Spanish laws in hand, do not they have the act because they did not go personally to Madrid to abide by the Constitution.

The JEC summons Puigdemont to go to Madrid for his MEP act

The Central Electoral Board (JEC) has issued a resolution responding to the president of the European Parliament, Roberta Metsola, in which it clarifies that the former Catalan president, Carles Puigdemont, and three other Catalan MEPs, with Spanish laws in hand, do not they have the act because they did not go personally to Madrid to abide by the Constitution.

As La Vanguardia has learned from sources within the body, in the resolution, adopted unanimously by the twelve members in attendance, Puigdemont himself, Clara Ponsatí, Toni Comín and Jordi Solé -substitute for Oriol Junqueras in the European Parliament- are summoned to that solve the situation "at any time by going to fulfill the same requirement that the other 55 elected deputies of the Kingdom of Spain have formalized".

According to these sources, the reason why there are only 55 is that the Spanish law does not have deadlines and therefore they remain vacant indefinitely until the candidate covers it or renounces it.

The JEC responds to Metsola that this body duly communicated to the European Parliament the list of elected deputies who meet the conditions to acquire the full status of deputies to Parliament. "In the only four cases in which the credential could not be issued, the reason has been the will of the four affected not to meet the requirements without the JEC being able to suppress that voluntary omission," the text states.

"The Central Electoral Board considers that Mr. Puigdemont has not acquired full status as a deputy to the European Parliament, as he has not fulfilled the requirement of constitutional compliance provided for in article 224.2 of the Loreg and that, as indicated in said provision, his seat must remain temporarily vacant until such compliance takes place, with the consequent suspension of his rights and prerogatives under the same terms. This is the reason why Mr. Puigdemont's credentials as a Member of the European Parliament have not been issued", Pick up the deal.

The Board insists that the Organic Law of the General Electoral Regime (Loreg) requires that a promise or oath must be taken to issue the credentials. These sources explain that the JEC also recalls that each decision adopted in this regard was reported to Parliament. In addition, the Supreme Court has already agreed with the JEC, a resolution that is being appealed to the Constitutional Court and that is still pending resolution.

For this reason, he considers that the President of Parliament, David Sassoli, who in his day gave them the minutes without taking into account the Spanish procedure, did not have the authority to speak of Spain's incompetence and "question the legality" of the lists of candidates officially notified by the Spanish authorities on June 17, 2019.

In addition, it insists that the principle of "loyal cooperation", recognized in article 4.3 of the Treaty of the European Union and invoked in the letter of the President of the European Parliament, "demands that respect in the fulfillment of the missions derived from the treaties be mutual between the European Union and the Member States".
