The first response of the independence movement to the ruling of the Superior Court of Justice of Catalonia (TSJC) that requires that a minimum of 25% of classes be taught in Spanish in Catalan classrooms has consisted of filing an appeal for reconsideration. The Generalitat has done it today specifically against the ultimatum of the judges so that it is applied before May 31. Despite the fact that the chances of success are slim, according to the same pro-independence environment, the Government has requested that the interlocutory be suspended until this appeal is resolved "due to the serious damage it can cause to the entire educational community at this point in the course ” school, a few days from completion. Likewise, the Generalitat considers that the Assembly for the Bilingual School is not entitled to request the execution of the sentence.

The resource prepared by the Legal Office of the Generalitat is just one more step and the time frame is just over a week. The situation is complex and the Government wants to act in all fields and to that end it is also preparing a decree law to safeguard "the centers and their linguistic projects", as explained by the spokeswoman for the Catalan Executive, Patrícia Plaja.

This decree will be different, as he explained, from the one presented yesterday by Junts per Catalaunya as a party to the Government, of which it is a part. However, the proposal of those of Carles Puigdemont precisely insisted that it be the Department of Education that assumes the cost of maintaining linguistic immersion and ultimately authorizes all those linguistic projects of the schools. It also has nothing to do with the decree that Minister Josep Gonzàlez-Cambray has been working on for weeks to retouch the Llei d'Educación de Catalunya (LEC).

Be that as it may, the appeal presented today by the Generalitat before the TSCJ also alleges that the Assembly for the Bilingual School, the entity that has requested the execution of the sentence, does not have the legitimacy to do so. In addition, he considers that the fact that the fifteen-day ultimatum imposed by the judges was based on his request "not only violates the law regulating the contentious-administrative jurisdiction, but also is contrary to the existing jurisprudence of the Supreme Court that has so far always maintained that in order to defend the interests of a group one must be legally authorized”. In other words, the Government ensures that today there is "no law" or legal reference that says that such an association represents the interests of citizens.

“You cannot prosecute teaching without weighing all the consequences that this has in the teaching field and, therefore, in the distorting impact that it has on all students”, Plaja said before assuring that the Government “will fight a decision [of the TSJC] that has nothing to do with pedagogy and a lot of ideology”.

But in parallel, from the Parlament also the PSC, Esquerra and the commons are finalizing a reform of the Law of Language Policy -which dates from 1998- to try to strengthen the Catalan language after the court ruling. JxCat joined this modification on March 24, but a few hours later it froze its participation. A few days ago, the post-convergents definitively got off the hook, and if there are no last-minute changes, their contribution will be limited to that proposed decree law. However, socialists, republicans and commoners have given a 24-hour limit to the postconvergents to be added to the legislative proposal, which makes explicit in its latest version that there are no percentages for the Catalan school model.
