However, the Justice has not yet ruled on the meaning of its decision regarding those sentenced to prison terms for embezzlement. Both the Prosecutor's Office and the private accusation in the case, brought by the PP, in separate writings two weeks apart, have opposed the suspension of the execution of the sentence of the TS, pointing out that "the penalties are to be served", despite that the incidents of annulment before the Supreme Court that each and every one of the accused have filed, as well as the request for pardon that they have requested from the Ministry of Justice, are still unresolved.

In said document, the First Section of the Hearing states that on October 11 it had already agreed to request the convicted José Salgueiro, former Deputy Minister of Economy and Finance; Magdalena Alvarez; former Minister of Economy and former Minister of Public Works; the former director general of the Agency for Innovation and Development of Andalusia (IDEA) Jacinto Cañete; the former president of the Board Manuel Chaves; the former Minister of the Presidency Gaspar Zarrías and the former Vice Minister of the Presidency and former General Director of Budgets, Vicente Lozano Peña, "for the fulfillment of the sentence of special disqualification to which they were sentenced."

Now, it resolves to require "equally" the former Employment Deputy Minister Agustín Barberá; the former Treasury Minister Carmen Martínez Aguayo; the former director of IDEA Miguel Ángel Serrano Aguilar; the former Minister of Innovation Francisco Vallejo; the former Deputy Minister of Innovation Jesús María Rodríguez Román; the former regional president José Antonio Griñán, the former Minister of Employment and Technological Development José Antonio Viera, the former General Director of Labor and Social Security Juan Márquez and the former Minister of Employment Antonio Fernández; "for the fulfillment of the sentence of absolute disqualification to which they were sentenced".

In another ruling, the same judicial instance announces that the new Anti-Corruption brief is still “pending to resolve” in which it defends the immediate execution of the sentence for those sentenced to prison.

It is the second time that the Prosecutor's Office pronounces in the same sense, and on this occasion it insists that "it was already taken into account to assess the origin of the suspension of the custodial sentence the fact of the presentation by the convicts of an incident of annulment, as announced by their procedural representations in their respective writings". For this reason, "the sentence handed down being final and it having to be complied with", the Anti-Corruption Prosecutor's Office reiterates "in all its aspects the content of the report dated November 2 of 2022", for which he was already opposing the suspension of the prison sentence imposed on the convicted Griñán Martínez, Fernández García, Viera Chacón, Vallejo Serrano, Barberá Salvador, Rodríguez Román, Márquez Contreras, Serrano Aguilar and Martínez Aguayo".

The private accusation, for its part, has joined the Anticorruption resolution on the two occasions on which it has spoken.

Let us remember that José Antonio Griñán was sentenced, in addition to prevarication, for a crime of continued embezzlement of public funds, and he was sentenced to 6 years and two days in the framework of this fraudulent framework of aid to companies and employees during the years of the last economic crisis, a system that caused a hole of almost 700 million euros in the regional accounts.

It was the Supreme Court that, in September, confirmed the convictions of the defendants in the ERE case, thus resolving the appeals filed against the initial sentence of the First Section of the Seville Court, which sentenced 19 of the 21 former senior socialist officials of the Junta de Andalucía judged by the financing system of the ERE.
