The Attorney General appoints Dolores Delgado as head of the Military Prosecutor's Office

The new Attorney General of the State, Álvaro García, has imposed his criteria and has proposed Dolores Delgado as Head of the Military Robed Prosecutor's Office. According to tax sources, García has proposed it despite not having a majority of votes in the Fiscal Council.

This battery of appointments are the first that García has adopted since he was appointed State Attorney General, appointed by the Government to replace Delgado, who in July announced his resignation for health reasons. Until then, Garcia had been his right hand man.

According to sources from the Fiscal Council, Delgado had obtained four votes, compared to six obtained by another prosecutor, Luis Rueda. However, García has imposed his criteria and has proposed him for the position, which must now be ratified by the Council of Ministers.

Delgado has obtained two votes from the members of the Fiscal Council from the Progressive Union of Prosecutors (UPF) in addition to the two natural prosecutors. For his part, Rueda has obtained six votes from the Association of Prosecutors, because although he is not associated, they have considered him the most prepared in military legal matters.

According to his resume, Delgado entered the prosecutor's career in 1990. In 1993 he joined the Special Anti-Drug Prosecutor's Office. In 2004, she was assigned to the National High Court Prosecutor's Office, where she has been an anti-terrorist prosecutor and coordinating prosecutor against jihadist terrorism. She has been Minister of Justice and Attorney General of the State, a position in which she was the superior director of the Military Legal Prosecutor's Office. She is currently assigned to the National High Court Prosecutor's Office.

This appointment of Delgado has been seen as an imposition by conservative prosecutors as they do not have a majority of the Fiscal Council. However, this is an advisory body and the attorney general can impose his criteria.

Álvaro García's performance is under scrutiny because he was head of the Technical Secretariat, at the proposal of Delgado, and also did not receive the support of seven conservative members of the General Council of the Judiciary (CGPJ), who understood that he did not meet the requirement of appearance of impartiality.

On the other hand, Alejandro Luzón has repeated in the position as chief prosecutor of Anticorruption. He was one of the prosecutors who signed the file of the proceedings of the king emeritus. He entered the prosecutor's career in 1989. In 1995 he became part of the Anti-Corruption Prosecutor's Office until his appointment as Lieutenant Prosecutor of the Technical Secretariat of the State Attorney General's Office in 2015 and holds the position of Chief Prosecutor of the Special Prosecutor's Office against Corruption and organized crime since 2017.
