Super League victory: UEFA will not be able to sanction the clubs

Strong court ruling in favor of the Super League. Neither FIFA nor UEFA will be able to sanction the clubs or threaten the project of this new competition. This is clear from the latest ruling of the Provincial Court of Madrid, which has upheld the appeal filed by the Super League against Commercial Court number 17 of Madrid, and dismisses the opposition raised by UEFA.

Spanish magistrates warned the main soccer governing bodies not to interfere in the preparations for the European Super League in which some of the best clubs participate. This conduct by FIFA and UEFA is "particularly serious" as they are organizations that "hold a monopoly" in the soccer market and abuse their dominant position to block a potential competitor, the judges said.

The company in charge of promoting the Super League, A22 Sports Management, has assured that the order that the Provincial Court of Madrid made public this Tuesday will allow it to "develop its project without threats."

Bernd Reichart, CEO, indicates in a statement issued after being notified of the order, that they welcome "with satisfaction the fact that this court decision allows A22 to freely continue the project of creating a new and exciting European football competition."

"It confirms that UEFA's monopoly position cannot be used to pressure or threaten clubs, players or companies eager to innovate," adds Reichart, who points out that they "will continue to dialogue with football stakeholders in a new environment and more appropriate, free from threats and other obstructionist measures taken by UEFA and other bodies".

A22 recalls that the Court "has agreed to fully restore the precautionary measures that are intended to protect the Super League and its clubs against threats from UEFA and FIFA, as well as against any actions by them (and their affiliated Federations and Leagues ) whose purpose is to prevent or hinder the project of the Super League".

"The Superior Court of Justice of Madrid has granted protection against any type of sanction while the legal proceedings continue. The case is now pending before the Court of Justice of the European Union and will later return to the Spanish courts. The Superior Court of Justice of Madrid, which has already fined UEFA and La Liga in the course of this legal proceeding for acting in "procedural bad faith", ordered UEFA to pay legal costs."

LaLiga, for its part, has assured that it accepts the order, but ensures that it remains waiting for the main procedure to be resolved once the ruling of the Court of Justice of the European Union is produced. "LaLiga, as an interested party in this procedure, accepts this precautionary pronouncement but awaits the resolution of the main procedure in the Commercial Court of Madrid once the ruling of the Court of Justice of the European Union (CJEU) is known. ", he said in a statement. Shortly after, UEFA has also urged to wait for the response of the European court.

"LaLiga trusts that the CJEU supports the current European model of sport, which has the support of the European institutions and national governments," adds the organization of the Spanish clubs, which ensures that "it is a firm defender of the current model of European football, which has demonstrated its success allowing an adequate development of our sport, football, from the base to the professional categories, with an adequate coexistence between the national leagues and the European competitions".

"The creation of a Super League outside of this governance model would also mean the end of the European national leagues, it would put an end to a model that has proven its effectiveness for more than 100 years and would break the dream of the millions of fans of national competitions" , indicates.
