Podemos says that the responsibility of adapting the Penal Code to the law was Justice

Podemos has refused to modify the law of the only yes is yes to which some parliamentary partners of the Government do open up, by ensuring that the regulations are "solid" and that the problem regarding the reduction of sentences in the review of sentences it is due to the erroneous and minority interpretation by some judges.

In addition, it has underlined the "special" responsibility, above Equality, that the Ministry of Justice had in everything related to the adaptation of the Criminal Code, and trusts that the Supreme Court unifies doctrine and resolves that there is no reduction of sentences to the protection of the regulations.

"We do not contemplate the scenario that the Supreme Court contradicts its own jurisprudence and it would seem unheard of to us," said the party's state co-spokesperson, Isa Serra, at a press conference on Monday.

Regarding the position of various parliamentary allies of the Executive, who advocate opening up to possible changes if there are dysfunctions in this law, he has replied that he is aware that there are groups that speak of the need to undertake a modification "but nobody says in what It should be reviewed and changed."

In fact, it has declined that option by defending the regulations as a "victory" for the feminist movement, which provides tools to combat sexual violence, with a transformation of the Penal Code and whose virtues exceed the punitive scope, since it puts emphasis on crime prevention and victim support.

Moreover, he has reiterated that the law passed through a multitude of ministries, was approved by the Council of Ministers and the Council of State, the General Council of the Judiciary and the Fiscal Council participated in its processing, in addition to being validated in Congress with the votes of ten political formations.

Likewise, in terms of the Criminal Code, he explained that the definition of the penalties came from the Ministry of Justice despite the fact that it is said to belong to Montero, since in that department he had a "special" responsibility in that area, no matter how much he tried to attribute it. to Equality, which also agrees and ratified, like the rest of the Government, a rigorous definition and without reduction of years in prison for those convicted.

And he has even stressed that the law that governs the Criminal Code has transitory provisions that guarantee the maintenance of the sentences in their initial terms.

In this way, he has denounced the "media avalanche" against Equality and the feminist advances with a political campaign of "disinformation" and "hoaxes" to the lowering of sentences for those convicted, precisely when the law protects the victim more and impunity for certain sexual assaults ends.

Therefore, Serra has reaffirmed that there are failures in justice when it comes to correctly applying the regulations, which are minority because, as he has estimated, the majority of cases the review does not touch penalties as has been decreed, for example, by the Provincial Court of La Rioja that should be "valued", together with the opinion of various jurists.

And on this point, he has insisted that it is "evidence" that progress is required in training judges with a gender perspective, as the United Nations warned of the persistence of "sexist stereotypes" that are still in force and compromise the victims.

What's more, the leader of the purple formation has stressed that only 8% of the victims who suffer sexual violence denounce it and that has to do with the "distrust" of women in the justice system, which must be resolved.

In conclusion, Serra has stressed that there are cases where the sentences are being reviewed incorrectly, at the same time that he has censured that the "political campaign" against the Law of 'only yes is yes' generates "insecurity" for the victims and " sex terror".

And in this regard, he has stressed that this reduction in sentences does not correspond to the jurisprudence, which, in his opinion, establishes that the sentences must continue to be maintained because the regulations do not alter them.

Meanwhile, the federal spokeswoman for the IU, Sira Rego, has assured that the law is "magnificent" and "all Democrats" should feel "proud" of it, since it is a "paradigm shift" that "broadens rights and the very democracy".

Consequently, it has called for waiting for the conclusions that the Supreme Court and the Attorney General decide, while at the same time it has considered the attacks that have been directed against Irene Montero "unjustifiable".
