Mother and son on the bench for collecting the pension of a deceased relative for 20 years

The Provincial Court of Madrid hosts this Tuesday the trial against a mother and her son for collecting 794.93 euros for twenty years from the pension of a relative despite having knowledge of his death.

The Provincial Prosecutor of Madrid requests 18 months in prison for them and claims 37,250.72 euros as civil liability, since the defendants have already repaid 111,544 euros to Social Security.

According to the indictment, M.I.C.M. and V.F.S.C. learned of the death of their relative on November 18, 1995, a circumstance that they did not notify the National Social Security Institute (INSS) or Banco de Santander, the entity where the woman received the pension of which he was the holder.

Thus, until the end of November 2015, the date on which the INSS became aware of the facts, the defendants had the amount of the aforementioned pension "which was deposited monthly into a Banco de Santander account of which the three were co-owners. ".

With the key to said account, both made purchases using the bank card of the deceased woman, had cash and even paid liens for public debts of the husband of M.I.C.M.
