Interior grants semi-freedom to Bárcenas after serving half of his sentence

The Ministry of the Interior has agreed to apply to the former treasurer of the PP Luis Bárcenas article 100.2 of the Prison Regulations, which includes the possibility of making the prison life regime more flexible to move to a situation of semi-liberty, according to sources familiar with the decision.

As El País has advanced, the decision has been adopted after Bárcenas has already carried out a large part of the program for the reinsertion of economic criminals, known by the acronym PIDECO, which the General Secretariat of Penitentiary Institutions, dependent on the Interior, launched in January 2020.

Bárcenas, classified in the second degree or ordinary regime, has enjoyed several prison permits since he entered the Soto del Real prison in Madrid to serve a sentence of 29 years and one month for the first period of the Gürtel case. It should be remembered, in any case, that the court imposed a maximum sentence of 12 years on him.

The measure, which can be appealed by the Prosecutor's Office, will allow him to leave jail to serve the rest of his sentence in a Social Integration Center, in the absence of specifying the execution plan that will determine if he sleeps in this establishment or if he will have some system of telematic control.

Bárcenas entered pretrial detention in mid-2013 and released it on bail on January 22, 2015. After Gürtel's sentence, he returned to prison in May 2018. The court established that the maximum time for compliance would be 12 years, which was corresponds to triple the highest penalty imposed, in this case, that of money laundering and against the Public Treasury.

In this way, the decision on flexibility through article 100.2, in response to the initial proposal of the Soto del Real treatment board, has been adopted once the prisoner has served half of the maximum sentence that can be deprived of liberty. .

Bárcenas had pending until this week the case investigated by the head of the Central Investigating Court Number 5, Santiago Pedraz, who has just filed the investigation into businessmen who allegedly fed the PP box b to receive specific public contracts.

The other judicial front of Bárcenas is the Kitchen operation but in this case as a victim. The head of the Central Court of Instruction Number 6, Manuel García Castellón, has prosecuted eleven people, with the former Minister of the Interior Jorge Fernández Díaz as the alleged mastermind, for the parapolice espionage that they would have directed against the former treasurer and his family to steal their sensitive information about the PP and its leaders that they could keep.

The 100.2 of Bárcenas coincides when his wife, Rosalía Iglesias, enjoys the first prison permits since he entered prison in November 2020 to serve the sentence in the Gürtel case, in his case for a sentence of 12 years and 11 months for the first period of the Gürtel plot.
