According to the ruling of the High Court, on which an appeal can be made before the Superior Court of Justice, the defendant's version that he claims to have had sexual relations with his former worker in a hotel in Madrid is credible, but that they were consented at all times. The account of both, at the discretion of the rapporteur magistrate, corresponds exactly except at the time of describing sexual relations.

The defendant assures that the former worker, after having dinner and having a few drinks in Madrid, when she got to the room she got between the sheets and they ended up having consensual sex. The victim, for her part, issues a story that does not coincide with her attitude, which, according to the speaker, describes that after the alleged assault, she acted normally with the accused: she went to have breakfast, traveled to Barcelona and accompanied her to her home.

The sentence disarms the thesis that the defendant had supplied the victim with a substance that made him drowsy. This, she vomited back to the hotel and stained her shoes, a test analyzed in the Police Toxicological Laboratory, which did not find any type of substance that could cause her "physical discomfort, drowsiness, weakness and unconsciousness." Therefore, it rules out the hypothesis that his aggression took place when he was "deprived of meaning" and because of a statement from the alleged victim that presents serious doubts and that he does not "compass with what happened during the night."

The three magistrates who have issued the sentence doubt the victim's version and wonder why she did not show her disagreement when upon arriving at the hotel she saw that they were in the same room and in beds together. There is also no story that the victim claims she made to a friend of hers, that she has not been located and that she was the one who advised her to file a complaint four days later.
