'El Pequeño Nicolás', sentenced to more than 3 years in prison for posing as a member of the Government

The Provincial Court of Madrid has sentenced Francisco Nicolás Gómez Iglesias, known as 'El Pequeño Nicolás', to 3 years and 5 months in prison for a crime of usurpation of public functions and a continued crime of falsifying an official document. Francisco Nicolás posed as a member of the Government of Mariano Rajoy in a property sale transaction.

In a sentence, to which Europa Press has had access, the "illicit conduct" of Gómez Iglesias "displayed in a personally ostentatious manner" has been considered accredited to "pretend in a highly convincing manner that it was a person who performed functions" in the Executive.

The Seventh Section has considered, however, that it is appropriate to acquit Gómez Iglesias of the crime of fraud attributed to him by the Prosecutor's Office, the State Attorney's Office and the popular accusation exercised by Podemos. The decision takes place after last November 7 the court left the trial in which 'El Pequeño Nicolás' denied that he was posing as a member of the Government to defraud businessman Javier Martínez de la Hidalga in the sale. of a farm located in Toledo called 'La Alamedilla'.

The Prosecutor's Office assured that the young man had posed as a member of the Vice-Presidency of the Government to try to get hold of the 300,000 euros that was in the account that the businessman had with his wife, but that, unable to do so, he asked for 25,000 euros in cash. , which is what they allowed him to withdraw.

The Public Prosecutor's Office and the State Attorney's Office requested a 6-year prison sentence for "El Pequeño Nicolás" for alleged crimes of fraud, document falsification and usurpation of public functions. The prosecutor also requested a penalty of special disqualification for passive suffrage and a fine of 18,000 euros. The popular accusation of Podemos asked Gómez Iglesias for 12 years in prison.

For the court, the results of the evidence taken during the trial, including statements and documents, "provide evidence to consider the illegal conduct" of Gómez Iglesias accredited.

"In this case, the defendant's behavior covered with his own statements, attributing himself to an official connection, embellished with simulated telephone calls to senior State officials, the preparation, delivery and exhibition of documents that pretended to be official and the use of badges reserved for official services are acts that undoubtedly generated the belief in third parties that the defendant worked for the Vice-Presidency of the Government and for the CNI", the Court concluded.

The court has also ruled on the defense argument that the young man suffers from a personality disorder. The magistrates have considered that said medical team "did not prevent him from having perfect knowledge of the reality of the facts or their consequences" and that he acted "consciously in order to obtain economic benefits for the operation that could culminate with Martínez de la Hidalga" .

The Prosecutor's Office asks for him 9 years and 9 months in prison for integration into a criminal group, a continued crime of discovery and disclosure of secrets and violation of secrets as an inducer and a crime of active bribery.
