Díaz opens the door to increase the compensation for unfair dismissal: "It is too cheap"

The Second Vice President of the Government and Minister of Labour, Yolanda Díaz, has opened the door to modifying the compensation for unfair dismissal, currently 33 days per year worked. "It's too cheap," the minister declared today in Congress in response to a question from ERC.

The labor reform agreed by the executive of PSOE and Unidas Podemos with the social agents did not address such a thorny issue, so it was closed without recovering the compensation of 45 days per year worked in force until the 2012 PP reform, which made dismissal cheaper .

However, the minister considers that the slight difference" between the compensation for a legal dismissal, of 20 days per year worked, with that of an unfair dismissal, of 33 days per year, is a "perversion of the system". there is effective protection against abuse", lamented Díaz, while adding that it is "so cheap" that some businessmen "find it out".

Díaz's reaction comes after two rulings by the Superior Court of Justice of Catalonia (TSJC) have been made public in recent days, establishing that compensation for unfair dismissal should be greater than 33 days per year worked. To this is added, in addition, the UGT's claim against the Government before the Council of Europe for considering that the Spanish legislation on unfair dismissals violates the European Social Charter, since it argues that the compensation in these cases - of 33 days with the limit of 24 monthly payments - is too low.
